July 6, 2019 - Laurel Park
#19-074 In the third race, at Laurel Park on July 4, 2019, horse #8 “Overpower”, ridden by jockey, Katie Davis was disqualified
from third position and placed sixth. Down the backstretch, #8 “Overpower” was angled in and came over into the path of #5 “Thirst for Quality”, ridden by Kevin Gomez. This action caused #5 “Thirst for Quality” to clip heels and fall.
[Violation under COMAR 09.10.01.50, A(1)a & e, which states in pertinent parts: “A horse may not: (a) Carry another horse in or out or (e) Impede another horse."]

Thirst for Quality - DNF

July 6, 2019 - Laurel Park
#19-075 Jockey, Katie Davis, is suspended fifteen calendar (15) days
, July 10, 2019 through July 24, 2019 for riding the horse “Overpower” in an extremely careless manner in the third race at Laurel Park on July 4, 2019, causing a horse to clip heels and fall. This action resulted in the disqualification of “Overpower” from third to sixth position.

July 12, 2019 - Laurel Park
#19-076 Jockey, Sheldon Russell, is fined one thousand dollars ($1,000.00)
and suspended five (5) days, July 15 through July 19, 2019, for failure to ride his mount “Rapid Dan” out to the finish in the fourth race at Laurel Park on July 11, 2019, thereby causing “Rapid Dan” to lose a placing in the order of finish.

July 13, 2019 - Laurel Park
#19-077 In the matter of jockey Ivan Perez

COMAR 09.10.03.05 A(1)(b),D
Mr. Perez was requested by the MRC Investigator to deliver a urine sample by 12:00 pm on July 10, 2019. Mr. Perez signed the request but failed to appear.

A hearing was held on July 12, 2019. Mr. Perez was requested to deliver a urine sample. Mr. Perez complied and the sample was positive for marijuana. COMAR 09.10.03.05 Drug Prohibition-Humans.

Accordingly, the Stewards hereby order:

  1. That the license issued to Ivan Perez be suspended until such time as he has been professionally evaluated [COMAR 09.10.03.05, F(1)(2)(a)(b)].
  2. That while he is under suspension, Mr. Perez be denied the privileges of all the grounds under the jurisdiction of the Maryland Racing Commission. [COMAR 09.10.01.45, 'Y (1) (a).].

July 13, 2019 - Laurel Park
#19-078 Trainer, Francis Abbott, III is fined twenty-five dollars ($25.00)
for not having the colors for “Too Much Tip”, entered to run in the seventh race at Laurel Park on July 6, 2019, after receiving a warning on (06/07/2019 ) for the same offense.
THIS IS A VIOLATION OF: [COMAR 09.10.01.09]

July 13, 2019 - Laurel Park
#19-079 Trainer, Jose Corrales, is fined Two hundred dollars ($200)
for not having a current coggins test on file with the racing office for his horse “Eje Gama” scheduled to run in the third race on June 23, 2019 necessitating a late scratch.

July 14, 2019 - Laurel Park
#19-080 On June 6, 2019, the Stewards received notice from the Truesdail Laboratories, Inc. that urine sample #29380, dated May 16, 2019, contained the drug dextrorphan which is not on the approved list of Controlled Therapeutic Substances for the Maryland Racing Commission. The Stewards established that urine sample #29380 was taken from the horse “Let’s Go Mick”, owned by Midwest Thoroughbreds, Inc. and trained by Jamie Ness, following the running of the seventh race at Pimlico Race Course on May 16, 2019. The Stewards notified Mr. Ness that: (1) the presence of dextrorphan in the system of “Let’s Go Mick” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

Mr. Ness did not exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)

The Stewards held a hearing via telephone on July 14, 2019. Mr. Ness waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. Let’s Go Mick” did carry dextrorphan in its system when it finished second in the seventh race at Pimlico Race Course on May 16, 2019, a violation under COMAR 09.10.03.04, Section C;
  2. Jamie Ness, as trainer, was the absolute insurer of, and responsible for, the condition of “Let’s Go Mick” at the time the horse ran (Sections D & F);
  3. A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
  4. An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing and a precedent set by the Maryland Racing Commission:
Trainer Jamie Ness will not be sanctioned.

A separate hearing was held concerning the Multiple Medication Violation Point System.

Trainer Jamie Ness will be assigned one (1) Multiple Medication Violation Point.

July 14, 2019 - Laurel Park
#19-081 On July 10, 2019, the Stewards received notice from Truesdail Laboratories, Inc. that blood sample #30039, dated June 22, 2019, contained the drugs dexamethasone at 48+-13pg/ml which is in excess of the accepted threshold level of 5pg/ml established by the MRC. See COMAR 09.10.03.01. The Stewards established that blood sample #30039 was taken from the horse “Loudon’s Song”, owned by Jacks or Better Farm, Inc. and trained by Kenneth Decker, following the running of the tenth race at Laurel Park on June 22, 2019. The Stewards notified Mr. Decker that: (1) the presence of dexamethasone at this level in the system of “Loudon’s Song” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing on July 14, 2019, wherein Mr. Decker waived his right to legal counsel and a split sample.

Based upon the evidence before them, the Stewards find the following:

  1. Loudon’s Song” did carry an overage of dexamethasone, in its system when it finished first in the tenth race at Laurel Park on June 22, 2019, a violation under COMAR 09.10.03.04,C;
  2. Kenneth Decker, as trainer, was the absolute insurer of, and responsible for, the condition of “Loudon’s Song” at the time the horse ran (Sections D & F);

Based upon the foregoing, the Stewards hereby order that:
Trainer Kenneth Decker, be fined in the amount of Five Hundred dollars ($500.).

A separate hearing was held to address the Multiple Medication Violation Point system.
Trainer Kenneth Decker will be assigned one-half (1/2) Multiple Medication Violation Point.

July 18, 2019 - Laurel Park
#19-082 Apprentice Jockey, Victor Rosales, is suspended three (3) Maryland racing days, July 20, 21 & 25, 2019, for riding the horse “Charismatic Blue” in a careless manner in the ninth race at Laurel Park on July 13, 2019.

July 28, 2019 - Laurel Park
#19-083 In the third race, at Laurel Park on July 26, 2019, horses #2 “Gold Cadillac”, ridden by jockey Ashley Castrenzie and #1 “Still Processing” ridden by apprentice jockey, Julio Correa were disqualified from second position and third positions and placed sixth and seventh.
Inside the 1/16 pole, #2 “Gold Cadillac” came over slightly into the path of #6 “Wee Bonnie Lass” while #1 “Still Processing” drifted out a couple of paths into the lane of #6 , forcing the rider to take up sharply to avoid clipping heels.
[Violation under COMAR 09.10.01.50, A (1) b & e, which states in pertinent parts: “A horse may not: (b) Cross or weave in front of another horse without sufficient clearance, or (e) Impede another horse.]
