RULINGS:
#23-015 On February 1, 2023, the Stewards received notice from Industrial Laboratories that blood sample #E587705 dated January 13, 2023, contained the drug phenylbutazone at 7.56 mg/ml +- .04mg/ml which is in excess of the accepted threshold of .3 mg/ml phenylbutazone established by the MRC. See COMAR09.10.03.01. The Stewards, having established that blood sample #E587705 was taken from the horse “I Can Do It”, owned and trained by Robert Gamber, following the running of the third race at Laurel Park on January 13, 2023. The Stewards notified Mr.Gamber that: (1) the presence of phenylbutazone, at this level, in the system of “I Can Do It” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing via telephone on February 4, 2023, wherein Mr. Gamber waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “I Can do It” did carry an overage of phenylbutazone, in its system when it finished first in the third race at Laurel Park on January 13, 2023, a violation under COMAR 09.10.03.04,C
(2) Robert Gamber, as trainer, was the absolute insurer of, and responsible for, the condition of “I Can Do It” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race shall be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing and taking into account mitigating circumstances, the Stewards hereby order that:

Trainer Robert Gamber not be fined due to mitigating circumstances.
Mr. Gamber be suspended fifteen(15) days, however the days are stayed provided he doesn’t have another infraction within 365 days of this ruling.
The horse, “I Can Do It” be disqualified from the third race from January 13, 2023.

RULINGS:
#23-016 Jockey, Carlos Lopez is in violation of the HISA riding crop rule #2280 (b)(1). During the running of the fourth race on January 22, 2023, jockey Lopez hit his mount “Time To Cruise” 10 times which is in violation of the 6 strike rule. On January 27, 2023 a hearing was held to review the race. The Stewards issued the following penalty.

(1)Mr. Lopez is fined Five hundred dollars ($500.00).
(2)Mr. Lopez is suspended three (3) racing days, February 10, 11 and 12, 2023.
(3)Mr. Lopez is issued 5 points

RULINGS:
#23-017 In the matter of the fourth race at Laurel Park on January 22, 2023, regarding the Official result. On January 26, 2023 the Stewards notified trainer Jamie Ness of a crop violation by the jockey of his horse “Time To Cruise” during the running of the fourth race on the January 22, 2023. The Stewards notified Mr. Ness that jockey Carlos Lopez struck his mount 10 times during the race, which is a HISA violation that calls for the disqualification of said horse. Mr. Ness waived his right to a hearing on this matter and has agreed to the penalty on behalf of the Ownership and himself. Based upon the foregoing, the Stewards hereby order that:

The horse, “Time to Cruise” be disqualified from the fourth race from January 22, 2023. The Horsemen’s Bookkeeper redistribute all monies for that race in accordance with the following order;

#23-021 In the matter of the claim of the horse “Girls Love Me” from December 9, 2022; On February 4, 2023 the Stewards conducted a hearing with owner/trainer Derrick Parram about the claim of his horse “Girls Love Me”. Mr. Parram waived his right to legal counsel at this time. The Stewards notified Mr. Parram that due to a positive test for a Prohibited Substance that according to HISA rule 2262 (c)(5) the claim of “Girls Love Me” be voided and all monies pertaining to the claim be refunded.

#23-022 Trainer, Tim Woolley is fined Twenty-five dollars ($25.00) for not having the colors for “Bring the Magic”, entered to run in the ninth race at Laurel Park on February 10, 2023, after receiving a warning on (01/16/2023) for the same offense.

THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part…… “It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from being notified may result in a suspension of license.)

#23-026 In the fifth race at Laurel Park on February 17, 2023, horse #9 “Spectrier”, ridden by apprentice Jockey Justin Lewis, was disqualified from second position and placed fifth. Inside the 1/8th pole, #9 “Spectrier” comes over and into the path of #4 “Slingshot Boy” ridden by Angel Cruz, without sufficient clearance, forcing that rider to take up sharply to avoid clipping heels.

#23-027 Trainer, Gilberto Zerpa is fined Twenty-five dollars ($25.00) for not having the colors for “Robbedinthebahamas”, entered to run in the sixth race at Laurel Park on February 19, 2023, after receiving a warning on (02/10/2023) for the same offense.

THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part…. “It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

RULINGS:
23-028 In the sixth race at Laurel Park on February 197 2023, horse #7 “Luv Ya Bye Bye”, ridden by Jockey Bryson Butterfly, was disqualified from first position and placed third. At the start, #7 broke in severely to the inside, soundly bumping #5”Here and Nofurther” ridden by Jevian Toledo, forcing him to take back. The #5 “Here and Nofurther” was beaten in a photo for second place and we believe this action kept him from achieving his maximum placing.
