RULINGS:
#23-029 In the matter of Jockey, Xavier Perez: Racetrack Security sent a report of an altercation on the backside barn area that occurred on February 5, 2023 involving Mr. Perez. Racetrack security did an investigation concerning this incident. A hearing was held on February 16, 2023. Mr.Perez appeared in the absence of counsel and waived his right thereto. The Stewards took testimony from several witnesses and had video evidence taken from the barn by Security cameras.

Accordingly, the Stewards hereby order:

(1) That the license issued to Xavier Perez be suspended for sixty (60) days. However forty-five (45) days of the suspension is stayed on a probationary period. Mr. Perez will not be permitted on the backside for a period of fifteen (15) days. If Mr. Perez has another incident involving a physical altercation or does not comply with order #2 the remaining days will be enforced and any additional penalty may be added on.
(2) Mr. Perez is ordered to complete an approved anger management program.
(3) Mr. Perez is to be fined one thousand ($1,000) dollars.

The suspension starts from March 6, 2023 and runs through March 20, 2023.

RULINGS:
#23-030 On February 17, 2023, the Stewards received notice from Industrial Laboratories that urine sample #E587860, dated January 28, 2023, contained the drug 2-(1-Hydroxyethyl) Promazine Sulfoxide at a level of 19.95 ng/ml+- 1.65 ng/ml which is above the threshold of 10 ng/ml set forth for this drug. The Stewards established that urine sample #E587860 was taken from the horse “Folly”, owned by Three M’s Racing and trained by Jonathan Maldonado, following the running of the eighth race at Laurel Park on January 28, 2023. The Stewards notified Mr. Maldonado that: (1) the presence of 2-(1-Hydroxyethyl) Promazine Sulfoxide at this level, in the system of “Folly” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

The Stewards held a hearing via telephone on February 26, 2023, wherein Mr. Maldonado waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1) “Folly” did carry an overage of 2-(1-Hydroxyethyl) Promazine Sulfoxide in its system when it finished second in the eighth race at Laurel Park on January 28, 2023, a violation under COMAR 09.10.03.04, Section C;
(2) Jonathan Maldonado, as trainer, was the absolute insurer of, and responsible for, the condition of “Folly” at the time the horse ran (Sections D, E & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing, the Stewards hereby order that:

(1) TrainerJonathan Maldonado be suspended Fifteen (15) days. The suspension is stayed under the stipulation that he not have another class 3 violation within 365 day period.
(2) Trainer Jonathan Maldonado be fined in the amount of Five hundred ($500.00) dollars.
(3) The horse “Folly”, be disqualified from the eighth race on January 28, 2023 at Laurel Park.
(4) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance with the following order:

RULINGS:
#23-031 On February 25, 2023, the Stewards received notice from Industrial Laboratories that urine sample #E587901, dated February 3, 2023, contained the drug 2-(1-Hydroxyethyl) Promazine Sulfoxide at a level of 33.6 ng/ml+- 1.7 ng/ml which is above the threshold of 10 ng/ml set forth for this drug. The Stewards established that urine sample #E587901 was taken from the horse “Tam Char”, owned by C & B Stables and trained by Charles A. Frock, following the running of the fourth race at Laurel Park on February 3, 2023. The Stewards notified Mr.Frock that: (1) the presence of 2-(1-Hydroxyethyl) Promazine Sulfoxide at this level, in the system of “Tam Char” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

The Stewards held a hearing via telephone on March 4, 2023, wherein Mr. Maldonado waived his right to a split sample and legal counsel.

Based upon the evidence before them, the Stewards find the following:

(1) “Tam Char” did carry an overage of 2-(1-Hydroxyethyl) Promazine Sulfoxide in its system when it finished first in the fourth race at Laurel Park on February 3, 2023, a violation under COMAR 09.10.03.04, Section C;
(2) Charles A. Frock, as trainer, was the absolute insurer of, and responsible for, the condition of “Tam Char” at the time the horse ran (Sections D, E & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
(4) An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing, the Stewards hereby order that:

(1) Trainer Charles A. Frock be suspended Fifteen (15) days. The suspension is stayed under the stipulation that he not have another class 3 violation within 365 day period.
(2) Trainer Charles A. Frock be fined in the amount of Five hundred ($500.00) dollars.
(3) The horse “Tam Char”, be disqualified from the eighth race on January 28, 2023 at Laurel Park.
(4) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance with the following order:

#23-037 In the matter of Apprentice Jockey Jeiron Barbosa; Mr. Barbosa’s apprentice allowance was to have expired on March 24, 2023. Having provided all documentation pertinent to his injury of November 8, 2022, apprentice jockey Barbosa is hereby granted eight (8) days of extension. This extension will now continue his apprentice allowance thru April 1, 2023.

#23-038 Jockey, Alexander Crispin is in violation of the HISA riding crop rule #2280 (b)(1). During the running of the first race on March 18, 2023, jockey Crispin hit his mount “Hellman” 10 times which is in violation of the 6 strike rule. On March 19, 2023 a hearing was held to review the race. The Stewards issued the following penalty.

(1) Mr. Crispin is fined Five hundred dollars ($500.00).
(2) Mr. Crispin is suspended three (3) racing days, March 26, 30 and 31, 2023.
(3) Mr. Crispin is issued 5 points

#23-039 In the matter of the first race at Laurel Park on March 18, 2023, regarding the Official result. On March 19, 2023 the Stewards notified trainer Calixto Juarez of a crop violation by the jockey of his horse “Hellman” during the running of the first race on the March 18, 2023. The Stewards notified Mr. Juarez that jockey Alexander Crispin struck his mount 10 times during the race, which is a HISA violation that calls for the disqualification of said horse. Mr. Juarez reviewed the race with the Stewards on March 19, 2023 and has waived his right to a hearing on this matter and has agreed to the penalty on behalf of the Ownership and himself. Based upon the foregoing, the Stewards hereby order that:

The horse, “Hellman” be disqualified from the first race from March 18, 2023. The Horsemen’s Bookkeeper redistribute all monies for that race in accordance with the following order;

#23-040 Trainer, Alexandra Hillegass is fined Twenty-five dollars ($25.00) for not having the colors for Wickosity”, entered to run in the third race at Laurel Park on March 19, 2023, after receiving a warning on (03/11/2023) for the same offense.

THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part……

“It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from being notified may result in a suspension of license.)

#23-041 Trainer, Miguel Rodriguez is fined Twenty-five dollars ($25.00) for not having the colors for “Mr. Thirfty”, entered to run in the fifth race at Laurel Park on March 19, 2023, after receiving a warning on (02/05/2023) for the same offense.

THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part……

“It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.

#23-042 In the first race at Laurel Park on March 24, 2023, horse #4 “Superstitieux”, ridden by apprentice jockey Jeiron Barbosa, was disqualified from second position and placed third. Inside the 1/16th pole, #4 “Superstitieux” comes out and bumps #7“Born For Victory” ridden by apprentice jockey Axel Concepcion, causing the horse shift out and switch leads.
