October 2019 Thoroughbred Rulings - Maryland Racing Commission

September 26, 2019 - Laurel Park
#19-110 On September 9, 2019, the Stewards received notice from the Truesdail Laboratories, Inc. that urine sample #30620, dated August 24, 2019, contained the drug dextrorphan
which is not on the approved list of Controlled Therapeutic Substances for the Maryland Racing Commission. The Stewards established that urine sample #30620 was taken from the horse “Live Aid”, owned by Robert T. Manfuso & Katharine Voss and trained by Katharine Voss, following the running of the third race at Timonium Race Track on August 24, 2019. The Stewards notified Ms. Voss that: (1) the presence of dextrorphan in the system of “Live Aid” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) She had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) She had the right to be represented by counsel at the hearing.

Ms. Voss did not exercise his right to the split sample testing.

The Stewards held a hearing via telephone on September 22, 2019. Ms. Voss waived her right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. Live Aid” did carry dextrorphan in its system when it finished second in the third race at Timonium Race Track on August 24, 2019, a violation under COMAR 09.10.03.04, Section C;
  2. Katharine Voss, as trainer, was the absolute insurer of, and responsible for, the condition of “Live Aid” at the time the horse ran (Sections D & F) ;
  3. A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
  4. An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing and a precedent set by the Maryland Racing Commission:
Trainer Katharine Voss will not be sanctioned.

A separate hearing was held concerning the Multiple Medication Violation Point System.

Trainer Katharine Voss will be assigned one (1) Multiple Medication Violation Point.

October 3, 2019 - Laurel Park
#19-111 In the fifth race, at Laurel Park on September 29, 2019, horse #11 “Curlington”, ridden by jockey Alex Cintron was disqualified from second position and placed sixth.
Inside the 1/16 pole, #11 “Curlington” drifted out, carrying #1”Law of the Land” out, into the path of #9 “Bye Bye Melvin” forcing that horse to take up and steady.

[Violation under COMAR 09.10.01.50, A (1) a & d, which states in pertinent parts: “A horse may not: (a) Carry another horse in or out (d) Intimidate another horse.]

October 3, 2019 - Laurel Park
#19-112 Trainer, Jeremiah O’Dwyer, is fined Two Hundred and Fifty dollars ($250.00)
for treating a horse in the entries causing a scratch.

October 10, 2019 - Laurel Park #19-113 On September 27, 2019, the Stewards received notice from the Truesdail Laboratories, Inc. that blood samples #30785, dated September 13, 2019, contained an overage of the drug mepivacaine which is on the approved list of Controlled Therapeutic Substances for the Maryland Racing Commission. The Stewards established that blood sample #30785 was taken from the horse “Emelina”, owned by Jose M. Gallegos-Hernandez and trained by William T. McMahon, following the running of the second race at Laurel Park on September 13, 2019. The Stewards notified Mr. McMahon that: (1) the presence of mepivacaine in the system of “Emelina” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

Mr. McMahon did not exercise his right to the split sample testing.

The Stewards held a hearing on October 4, 2019. Mr. McMahon waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

October 10, 2019 - Laurel Park #19-114 In the fourth race, at Laurel Park on October 6, 2019, horse #5 “Little Skiff”, ridden by apprentice jockey Avery Whisman, was disqualified from fifth position and placed seventh. Past the ½ mile pole, #5 “Little Skiff”, dropped down into the paths of #7 “Believe Indeed” and #2 “What the Beep” forcing both riders to take up sharply to avoid clipping heels.

[Violation under COMAR 09.10.01.50, A (1) b & e, which states in pertinent parts: “A horse may not: (b) Cross or weave in front of another horse without sufficient clearance, or (e) Impede another horse.]

#19-115 Apprentice jockey, Avery Whisman, is suspended three (3) Maryland racing days, October 14, 17 & 18, 2019
, for riding the horse “Little Skiff” in a careless manner in the fourth race at Laurel Park on October 6, 2019, thereby causing the disqualification of “Little Skiff” from fifth to seventh position.

#19-116 Trainer, C. Beale Payne is fined twenty-five dollars ($25.00)
for not having the colors for “Topline”, entered to run in the sixth race at Laurel Park on October 13, 2019, after receiving a warning on (09/14/2019 ) for the same offense.

#19-117 Trainer, Manolo Mangual is fined twenty-five dollars ($25.00)
for not having the colors for “Gi Jo Man”, entered to run in the ninth race at Laurel Park on October 13, 2019, after receiving a warning on (09/15/2019 ) for the same offense.
