Are you a worker who has been classified as an independent contractor by the person or business for which you work?  Do you believe that you should be classified as an employee?  Employees who are misclassified are denied the protections afforded to other employees including unemployment insurance coverage, Workers’ Compensation coverage, minimum wage and overtime and other benefits that are typically provided to employees.  If you believe that the person or business for whom you work has incorrectly classified you as an independent contractor, you can file a report with the Worker Classification Protection Unit and we will investigate your case to determine your correct status.  All allegations of worker misclassification are taken seriously.

Are you unsure how to classify the workers who perform services for you or your business?  Would you like us to provide guidance regarding your workers’ status BEFORE someone files a misclassification report and our investigators show up to conduct an investigation?  Determining whether a worker is an employee or an independent contractor can be a difficult and confusing task for a business owner.  If you are unsure how you should treat your workers, you can submit a Request for Worker Classification Guidance to the Director of Strategic Outreach and we will assist you in determining how to properly classify your workers.  The Worker Classification Protection Unit and the Office of the Secretary, Strategic Outreach offer direct business assistance as well as workshops for businesses, trade associations, industry groups and others interested in learning more about proper worker classification.
