RULINGS:

#22-126 On December 10, 2021, the Stewards received notice from the Industrial Laboratories that blood sample #32533, dated November 18, 2021, contained the drug aminocaproic acid which is not permissible in a post race test. The Stewards established that blood sample #32533 was taken from the horse “Don’t Call Me Mary”, owned by The Elkstone Group, LLC and trained by Todd Pletcher, following the running of the eighth race at Laurel Park on November 18, 2021. The Stewards notified Mr. Pletcher that: (1) the presence of aminocaproic acid in the system of “Don’t Call Me Mary” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

Mr. Pletcher did exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)
Upon receiving confirmation from New York Drug Testing and Research Program that aminocaproic acid is present in sample #32533 dated November 18, 2021, at a quantity level of 15.0 ng/ml.

The Stewards held a hearing on this matter April 1, 2022 and continued the hearing June 2, 2022 wherein Mr. Pletcher was represented with legal counsel, Ms. Karen Murphy.

Based upon the evidence before them, the Stewards find the following:

(1) “Don’t Call Me Mary” did carry aminocroic acid in its system when it finished first in the eighth race at Laurel Park on November 18, 2021, a violation under COMAR 09.10.03.04, Section C;
(2) Todd Pletcher, as trainer, was the absolute insurer of, and responsible for, the condition of “Don’t Call Me Mary” at the time the horse ran (Sections D, E & F);
(3) A horse found to have carried a drug in its body during a race shall be disqualified and the purse monies earned by that horse redistributed and

Based upon the evidence presented at the hearing and taking into account mitigating circumstances, the Stewards hereby order that:

  • Trainer Todd Pletcher not be fined or assessed any MMV points.

 

  • The horse “Don’t Call Me Mary”, be disqualified from the eighth race on November 18, 2021 at Laurel Park.

(3) The Horsemen’s Bookkeeper redistribute all purse monies for that race in accordance
with the following order:

#22-127 In the third race at Laurel Park on June 4, 2022, horse #3 “M’Lady Thatcher”, ridden by
jockey Johan Rosado, was disqualified from first position and placed fourth. Past the 5/8th
pole, #3 comes out into the path of #4”Nice Quist” ridden by jockey Horacio Karamanos,
causing that horse to clip heels and stumble.

COMAR 09.10.01.50 A (1)(b)(e) which states in pertinent parts: “A horse may not (b) Cross or weave in front of another horse without sufficient clearance; (e) Impede another horse;]

#22-128 In the matter of the third race at Laurel Park on June 4, 2022, regarding the Official result. Stewards ruling #22-127.

On June 4, 2022, trainer Lacey Gaudet, Jr. filed an appeal with the Maryland Racing Commission. The appeal contests the Stewards' decision to disqualify the horse “M’Lady Thatcher” from first position.

As a result of that appeal, the third race on June 4, 2022, is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission:

(1) Both “Gustav’s Girl” and “M’Lady Thatcher” shall be subject to all penalties attached to the winner of the race [COMAR 09.10.04.15, A (1)]; and
(2) The purse monies affected by the dispute are to be held by the Horsemen's Bookkeeper.

#22-129 In the matter of the eighth race at Laurel Park on November 18, 2021, regarding the Official result. Stewards ruling #22-126.

On June 4, 2022, Attorney Karen Murphy filed an appeal on behalf of trainer Todd Pletcher with the Maryland Racing Commission. The appeal contests the Stewards' decision to disqualify the horse “Don’t Call Me Mary” from first position.

As a result of that appeal, the eighth race on November 18, 2021, is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission:

The purse monies affected by the dispute are to be held by the Horsemen's Bookkeeper.

#22-131 In the matter of the seventh race at Laurel Park on March 18, 2022;

On June 7, 2022, the Maryland Racing Commission convened to hear the appeal of jockey Grant Whitacre. The Commission voted to uphold the Stewards decision in this matter. As a result of this hearing Grant Whitacre is ordered to pay a fine of One thousand-five hundred dollars and serve a 5 day suspension. Mr. Whitacre has accepted the Commissions’ ruling. Mr. Whitacre will serve his suspension starting on June 10, 2022 and running through June 14, 2022.

#22-138 On April 20, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E452054 dated April 2, 2022, contained the drug phenylbutazone at 1.4+-.07 mg/ml which is in excess of the accepted threshold of .3 mg/ml phenylbutazone established by the MRC. See COMAR09.10.03.01. The Stewards, having established that blood sample #E452054 was taken from the horse “Free Square”, owned by Lucky 7 Stables and trained by John J. Robb, following the running of the third race at Laurel Park on April 2, 2022. The Stewards notified Mr.Robb that: (1) the presence of phenylbutazone, at this level, in the system of “Free Square” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.


The Stewards held a hearing via telephone on June 11, 2022, wherein Mr. Robb waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “Free Square” did carry an overage of phenylbutazone, in its system when it finished third in the third race at Laurel Park on April 2, 2022, a violation under COMAR 09.10.03.04,C ;
(2) John J. Robb, as trainer, was the absolute insurer of, and responsible for, the condition of “Free Square” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing, the Stewards hereby order that:

(1)Trainer John J. Robb be fined One thousand ($1,000.00) dollars.

(2)The horse, “Free Square” be disqualified from the third race from April 2, 2022.
(3)The Horsemen’s Bookkeeper redistribute all monies for that race in accordance with the
following order;

#22-140 In the matter of the horse “Doomscroller” owned by Robert J. McGee and trained by Marilyn McMullen in the third race on June 17, 2022 at Laurel Park. On June 18, 2022
the Stewards were notified by the Racing Secretary that the horse “Doomscroller” which ran on June 17, 2022 was ineligible for the waiver designation with which it ran. A hearing was held on June 19, 2022 including Ms. McMullen.

Based upon the evidence and testimony presented at the hearing, the Stewards find that:
The horse “Doomscroller”, trained by Marilyn McMullen, was not eligible to claim the
waiver designation with which it ran and therefore disqualified from the third race on
June 17, 2022.

RULINGS:
#22-146 On March 16, 2022, the Stewards received notice from Industrial Laboratories that blood sample #E451811 dated February 27, 2022, 2021, contained the drug methocarbamol at 2.51+-0.19 ng/ml which is in excess of the accepted threshold of 1 ng/ml established by the MRC. See COMAR09.10.03.01. The Stewards, having established that blood sample #E451811 was taken from the horse “The Wolfman”, owned by Joanne Shankle and trained by Roldolfo Sanchez-Salomon, following the running of the seventh race at Laurel Park on February 27, 2022. The Stewards notified Mr.Sanchez-Salomon that: (1) the presence of methocarbamol, at this level, in the system of “The Wolfman” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

Mr. Sanchez-Salomon did exercise his right to the split sample testing. (COMAR 09.10.03.09
H 1, 2, & 3) Upon receiving confirmation from Analytical Forensic Testing Laboratory that
methocarbamol is present in sample #E451811 dated February 27, 2022, at a quantity level of
2.35+-0.22 ng/ml-.
The Stewards contacted Mr. Sanchez-Salomon of the results of the split sample.

The Stewards held a hearing on June 26, 2022, wherein Mr. Sanchez-Salomon waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:
(1) “The Wolfman” did carry an overage of methocarbamol, in its system when it finished first in the seventh race at Laurel Park on February 27, 2022, a violation under COMAR 09.10.03.04,C ;
(2) Rodolfo Sanchez-Salomon, as trainer, was the absolute insurer of, and responsible for, the condition of “The Wolfman” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed.

Based upon the foregoing, the Stewards hereby order that:

(1)Trainer Rodolfo Sanchez-Salomon be fined Five hundred ($500.00) dollars.

(2)The horse, “The Wolfman” be disqualified from the seventh race from February 27, 2022.
(3)The Horsemen’s Bookkeeper redistribute all monies for that race in accordance with the following order;
